Ownership and contact details

IBARRAPPS SL, with tax ID no. B55486476 and registered address for notices at Calle Francisco Morano 2, Zaragoza (Spain), registered in the Commercial Registry of Zaragoza (IRUS: 1000423573570, Sheet Z-74232), owns the Freeday application and website. You can contact us at support@appfreeday.es.

What Freeday is and what it is not

Freeday is a platform that connects self-employed professionals and companies who have availability with those who need a one-off job covered, using geolocation and in real time.

Freeday acts solely as a technological intermediary: it does not provide the professional services arranged through the platform, does not take part in the negotiation, does not set prices and does not guarantee that the parties will reach an agreement.

Freeday charges no commission on the amounts agreed between users for their work.

Registration and account

Registration is required to use Freeday. By registering, the User undertakes to:

• Be over 18 and have the legal capacity to enter into contracts.
• Provide truthful, complete and up-to-date information, especially regarding their professional activity.
• Keep a single account and not transfer or share it with third parties.
• Keep their access credentials safe and take responsibility for activity carried out with them.
• Report any unauthorised use of their account immediately.

Proper use of the service

The User undertakes to use Freeday in accordance with the law, in good faith and in line with these Terms. The following is expressly prohibited:

• Impersonating another person or claiming qualifications, licences or experience they do not hold.
• Publishing unlawful, misleading, offensive or discriminatory content, or content that infringes third-party rights.
• Sending bulk communications, advertising or outreach unrelated to the purpose of the platform.
• Automatically extracting other users' data, or using platform information for purposes other than those intended.
• Interfering with the operation of the application, circumventing its security measures or accessing unauthorised areas.

IBARRAPPS SL may suspend or cancel, on stated grounds, any account that breaches these Terms or applicable law.

Freeday Pro subscription

Freeday can be used free of charge. Freeday Pro is an optional auto-renewable paid subscription that unlocks additional features, such as greater profile visibility, open-ended availability or choosing specific dates.

• Plans and price: the available plans (monthly, quarterly and annual) are shown on the app's subscription screen, with the price per period, taxes included and in your country's currency, before you confirm the purchase.
• Automatic renewal: the subscription renews automatically at the end of each period for the same amount, unless it is cancelled at least 24 hours before the renewal date.
• Billing: payment is taken through your App Store or Google Play account, depending on the device, and is charged when you confirm the purchase and on each renewal.
• Cancellation: you can cancel at any time in the subscription settings of your App Store or Google Play account. Cancellation takes effect at the end of the period already paid for and does not entitle you to a refund of the current period.
• Refunds: these are handled by the app store you purchased through, in accordance with its own terms.
• Promotions: where a promotion includes benefits offered by third parties, its specific terms are set out in the promotion itself.

Deleting the application does not cancel the subscription: it must be cancelled in your app store account settings.

Relationship between users

The price, scope, timescales and all other terms of each job are agreed directly between the users involved, outside Freeday.

Each user is responsible for meeting their own legal, tax, employment and social security obligations, and for holding the qualifications, insurance and authorisations their activity requires.

IBARRAPPS SL is not liable for the quality or performance of work agreed between users, nor for non-payment or damages arising from that relationship.

Content published by the User

The User is responsible for the content they publish on the platform (profile, photographs, job descriptions and reviews) and warrants that they hold the rights needed to share it.

By publishing it, the User grants IBARRAPPS SL a non-exclusive, royalty-free licence, limited to displaying that content on the platform for the purpose of providing the service.

IBARRAPPS SL may remove content that infringes the law, third-party rights or these Terms.

Intellectual property

The application, the website, the software, the Freeday brand, the designs and all other elements of the platform belong to IBARRAPPS SL or to third parties who have authorised their use. The User is granted only a personal, non-exclusive, non-transferable and revocable right of use, limited to the purpose of the platform.

Availability and liability

IBARRAPPS SL takes reasonable steps to keep the service available, but does not guarantee the absence of interruptions or errors, nor that professionals will be available in a particular area or trade at any given moment.

To the extent permitted by law, IBARRAPPS SL's liability towards the User is limited to the amounts actually paid by the User for their subscription during the twelve months preceding the event giving rise to it. Nothing in these Terms excludes liability for wilful misconduct or the rights granted to consumers by mandatory law.

Term and cancellation

These Terms remain in force while the User uses the service. The User may leave and request deletion of their account from within the application or by writing to support@appfreeday.es.

Closing the account does not by itself cancel an active subscription: it must be cancelled in the app store, as set out in the subscription section.

Data protection

The processing of the User's personal data is described in the Privacy Policy, which forms an integral part of these Terms.

Changes to the Terms

IBARRAPPS SL may amend these Terms for legal or technical reasons or because of changes to the service. Material changes will be communicated with reasonable notice through the application or by email. Using the service after they take effect implies acceptance.

Governing law and dispute resolution

These Terms are governed by Spanish law. For users acting as consumers, the courts of their place of residence shall have jurisdiction; in all other cases, the courts of Zaragoza (Spain).

Before turning to other channels, any complaint can be sent to support@appfreeday.es, where we will try to resolve it as quickly as possible.
